Tutela penal do consumidor como expressão de políticas eficientistas no Brasil, na Costa Rica e na Venezuela

Abstract

O presente artigo se propõe a analisar os referenciais teóricos que tratam a expansão do Direito Penal como consequência do eficientismo, a fim de verificar se a criação dos crimes contra as relações de consumo, no contexto político de alguns países da América Latina, pode ser caracterizada como uma concretização desse fenômeno. Observa-se que, em certos países, a expansão penal para a seara do consumidor – até então exclusivamente cível – é coerente com outras legislações e com políticas criminais repressivas e violentas que caracterizam os modelos eficientistas. Dessa forma, a criminalização nas relações de consumo seria apenas mais uma peça no maquinário da estrutura criada pelos movimentos de lei e ordemThis study aims to examine the theoretical frameworks that address the expansion of criminal law as a result of efficientism in order to verify that the creation of crimes against consumer, in the political context of some Latin American countries, can be characterized as an embodiment of this phenomenon. It is observed that in some countries, the expansion of criminal law to consumer sphere – up to that time exclusively civil - is consistent with other laws and with repressive and violent criminal policies that characterize the eficientism model. Thus, the criminalization in consumer relations would be just another piece in the machinery of the structure created by the movements of law and order
